The Military Court is competent for the trial of criminal offences committed by militaries contrary either to the Military Criminal Code and Procedure Law 40/1964 as amended (M.C.C.) or the Common Criminal Code Cap. 154 as well as any other Legislation subject to section 5 of the M.C.C. irrespective of the provided sentence.
Furthermore, the Military Court is competent for the trial of criminal offences committed by reservists and conscripts contrary to sections 67 and 68 of the National Guard Law 19(I)/2011 as amended.
The Military Court comprises by the President of the Military Court, a judge who is a member of the Judiciary, and two member judges who are militaries holding the office of Captain or superior. However, if the accused holds the commission of Brigadier General or higher, the Military Court is constituted in the same manner as the Assize Court.
